The 9th U.S. Circuit Court of Appeals has ruled that gun shops have the same rights to bear arms under the 2nd Amendment as individuals do. Three men were trying to open a gun shop in Alameda County, California and were denied because the proposed store was within 500 feet of a residential area. The Court ruled the ordinance did involve the Second
Amendment because the right to purchase and sell arms is "part and
parcel of the historically recognized right to keep and to bear arms."
The county, therefore, has to present evidence to justify the
restriction and can't simply assert that gun stores increase crime."
Coming from the predominantly liberal 9th Circuit, this ruling is stunning. Maybe there is hope for the county yet.
