The story is circulating again that Obama has
found a way around the 2nd Amendment to the Constitution of the
United States, by signing a treaty with members of the United Nations that will
nullify the Amendment and put gun control into U.S. law. Although the U.N. has been studying the
possibility of an Arms Trade Treaty that could have an impact on us, were it
not for the 2nd Amendment, these are the facts:
- The “treaty” has yet to be drafted, and is in the conversational stage
- No such treaty could bypass normal legislative process in the U.S.; even if signed by Secretary of State Clinton, such a treaty must be ratified by a 2/3 vote of the U.S. Senate before having any effect at all.
- Neither the Secretary of State nor the President can enact a complete ban on all weapons owned by U.S. citizens through the signing of international treaties with foreign nations.
- In the 1957 case of Reid v. Covert, the Supreme Court ruled that the Constitution supersedes even international treaties ratified by the U.S. Senate.

properly advises that there is no “legal way around the 2nd
Amendment” other than a new Amendment to the Constitution that repeals or
alters it, or a Supreme Court decision that radically interprets how the 2nd
Amendment is to be applied.
All of that having been said, if Obama gets
reelected and the Democrats continue to control the Senate, and if a
conservative Member of the Supreme Court resigns or dies thereby leaving Obama
with the opportunity to appoint another radical left Judge to the Court…. we’re
screwed.
Unless we vote Obama and the Senate Democrats
out, I don’t like the odds.
