Executive Orders Are Not Law

The way Joe Biden and the Democrat Mafia would have you believe, an Executive Order issued by them is the law of the land, which you had better damned-well comply with. Well, that’s simply not true. 

 

Laws are promulgated as Bills only by the Congress or a State Legislature; once signed by the President or the Governor, they become law. The courts, whether State or Federal, interpret the laws and apply the penalties for violation or the mandates contained therein.  A court interpretation will have a bearing on how the law is applied.  Where a matter of dispute not covered by a law comes before a court and the court decides the matter, that decision becomes precedent and acts as the law until overturned by a higher court or replaced by a law. That’s the essence of it. 

 

So, just what is an Executive Order?  

 

The President is charged with applying and administering the laws.  He has an inherent power to issue orders to his agencies and staff to accomplish that responsibility. Those “Executive Orders only apply to government officials and agencies under his control. So, when he issues an Executive Order ordering all flags to be flown at half-staff in honor of somebody, Joe Blow in Tuscaloosa, Utah can ignore it.

 

In the same vein, when Uncle Joe issues an Executive Order prohibiting the possession of an AR-15, only government employees or agencies have to comply.  If you choose to comply, that’s up to you.  If Uncle Joe wants to make you comply, he has to ask Congress to bass a Bill, he has to sign it… and it then becomes law... 

 

Unless the federal court system rules that law to be unconstitutional. 

 

So there, Uncle Joe! Take your far-reaching, zealous Executive Orders and stick ‘em where the sun don’t shine.
