U.S. District Court Judge Arthur Schwab of Pennsylvania has issued an opinion declaring Obama's recent Executive Order on immigration to be unconstitutional. He said parts of the E.O. are invalid and amount to "legislation from the Executive Branch." "President Obama's unilateral legislative action violates the separation
of powers provided for in the United States Constitution as well as the
Take Care Clause, and therefore, is unconstitutional," the judge wrote.
Well, that's just fine and dandy and I agree with what the Judge said.
Now, here's the problem: The opinion did not come as a result of a direct challenge to the E.O. in his court. Rather, the Judge was hearing another case regarding deportation of an immigrant and the question arose as to whether or not the issue was moot because Obama's E.O. might relieve the illegal of any need to be deported.
The opinion is certainly a good first step in bringing the outrageous E.O. to judicial scrutiny. But, there is one helluva lot of work to be done before the real substance of the matter gets before the Supreme Court. The good news is that a Federal Judge seems to agree with us.
